Terms and Conditions
In the following conditions of the contract "the photographer(s)" shall mean Sarah Pickin or any photographers/videographers appointed by Sarah Pickin.
"The client(s)" shall be those whose name(s) appear on the contract. If the client(s) arranges for a third party to meet the costs of this contract, the contract remains with the client(s). The due performance of the contract is subject to the conditions below. These cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer/videographer(s) in writing.
Copyright
The copyright of all images is owned by the photographer(s).
Upon delivery of the final images to the client(s), they are given permission to print and share their images as agreed with by the photographer(s).
Please do not edit or manipulate images without permission.
Display
The client(s) hereby allows the photographer(s) to display any photograph/footage covered by this contract to generally promote their business in advertising, brochures, magazine articles, websites, sample albums and prints, venue and other vendor samples and other such material, providing that the images/media used are used lawfully and without damage to the client(s). The client may opt out of this if they wish to.
Images placed in password-protected galleries within the website are not available to the general public in the normal course of events.
Licence, Coverage & Reproduction
The photographer(s) shall be granted an artistic licence in relation to the poses photographed and the locations used. The photographer(s) judgement regarding the location, poses, and the number of photographs/footage taken shall be deemed correct.
Photographs/footage taken during the course of the booking will be at the discretion of the photographer(s) although every effort will be made to comply with The Client(s) requirements.
The photographer(s) shall endeavour to photograph everything previously agreed and requested by the client(s), but no responsibility will be taken by the photographer(s) on the occasion of leaving something out..
Raw photos are not available to the client(s) under any circumstances.
Due to a variety of lighting conditions, some colours may alter throughout a set of photographs.
Although all equipment is checked regularly, serviced and reasonable steps are taken to ensure backup equipment is available, the photographer(s) will not be responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.
Payment
A non-refundable retainer of 30% is required to secure your booking, paid by cash, cheque or online bank transfer. If the client(s) needs to reschedule, a new date can be arranged. Your booking is not secure without the retainer paid.
The retainer forms part of the total cost of the fee (i.e. it is NOT in addition to the cost of the fee) and is deducted when calculating the final balance due. The retainer is refundable during your 14 days “cooling off” period. Payment for the photographic coverage is due in full NO LATER THAN FOUR WEEKS prior to the contracted date. You MUST allow sufficient time for cheque clearance. Non-receipt of the full balance by the due date will be deemed cancellation of the contract by the client(s).
Additional goods must be paid for in full at the time of ordering.
Please note that any alterations made to the booking by the client(s) once details have been confirmed may only be made at the discretion of the photographer(s) and in some circumstances (such as a change of date) the photographer(s) may be unable to accommodate these changes due to conflict of commitments. Under these circumstances the photographer(s) is not liable to compensate the clients in any way.
Cancellations & Force Majeure
Cancellations made by the photographer(s) will be refunded in full.
Ideally any date that needs to be cancelled by either the photographer(s) or client(s) will try to be rescheduled first.
The photographer(s) may contact other photographers in the event that they are unable to attend your booking. However, it may prove difficult or impossible to find a skilled replacement at short notice or the same price.
In the unlikely event that images are lost due to technical issues the client will be refunded. Re-shoots can be arranged however, the photographer(s) will not be responsible for the costs in order to stage re-shoots.
If the client(s) wishes to cancel the booking after the 14 day cooling off period the retainer is non-refundable.
Cancellation by the client(s) within 1 month of the day of the booking must pay 75% of the final cost within 30 days to cover expenses and loss of earnings. The client(s) will be refunded in full if the photographer(s) manages to rebook the date.
Personal Accident
Any directions issued to the client(s) are at their own risk. The photographer(s) cannot take responsibility for any personal accidents during a photoshoot.
Delivery & Amendments
The photographer(s)will endeavor to deliver all final digital images as quickly as possible via a private online gallery, this could take up to 6 weeks during busy periods.
One round of amendments to editing can be made at the proofing stage if desired; any further amendments the client(s) requests will be charged £30 per image.
